Terms and Conditions
Payments and deposits must be processed and approved BEFORE project starts.
Projects over $500 are 50% due at start and balance due upon approval and before release. Projects under $500 are 100% due at start of project.
To submit payment for your project(s) go to Rates Page and click the PayPal Buy Now button. All major credit cards and bank account transfers accepted. By submitting your payment, you acknowledge that you have read and agree to the terms and conditions of Exceptional National Marketing.

FOR YOUR PROTECTION AND BENEFIT, IN ORDER FOR A PROJECT TO BEGIN AND TO BE ABLE TO PROVIDE YOU WITH THE BEST POSSIBLE SERVICES, YOU MUST CAREFULLY READ AND ACKNOWLEDGE YOUR UNDERSTANDING OF AND AGREEMENT TO THE FOLLOWING POLICIES PRIOR TO SERVICES BEING RENDERED. BY SUBMITTING YOUR PAYMENT, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO THE TERMS AND CONDITIONS SETFORTH HEREIN:
Services - Payment - Provisions
I. We will do our best to work within your time schedule, remember however that turn-around time highly depends on you. Client changes, approvals and timely payments can influence the turn-around time schedule. If during the course of your project you are unable to provide us with necessary information, materials, payment or feedback in a timely manner when requested it could become necessary to reschedule your project. This may result in your project losing its place in queue and result in a delay as well as possible additional charges. Client further understands that each project is unique and circumstances do arise that are unforeseen. Exceptional National Marketing will do its utmost to handle these circumstances with the Client's best interest in mind. Your web site is one of a kind. Exceptional National Marketing prides itself on unique and exceptional designs.
II. If we request payment, materials, information, decisions, or approvals from you that we need to complete the project, and you do not provide them within fifteen days of our request, we will deem the project to be completed and all payments due.
III. We strive to make you happy and will make necessary changes as your project progresses. Changes however are not unlimited and, depending on the project, will be charged at an hourly rate. Each project will come with a simple written contract between Exceptional National Marketing and you, the Client. This contract is done to prevent misunderstandings and will let you know the fundamentals of what your project will entail.
IV. All actions available by law will be conducted by Exceptional National Marketing for any unpaid service that has been rendered.
V. All project design work and ownership stays with us until full payment has been made. Everything produced for your project and everything on this site, including but not limited to text, graphics, photographs, design, code, archived articles, etc., is copyrighted and belongs to ENM, unless said is provided to ENM by Client. You may not use any designs or any part of a design outside the use of the website. If you want to use any material appearing on this site, you must first obtain permission. ENM has full right to display their name on Client's website with a link to ENM's site. All rights reserved.
VI. Refund requests can be made. Refunds will not be given for pre-approved design work.
VII. Your privacy is important to us. Client contact information is used to contact the Client when necessary. It is not distributed to third parties. This site contains links to other sites. Exceptional National Marketing is not responsible for the privacy practices or the content of such websites.
VIII. Exceptional National Marketing does not warrant that the functions contained in Client's web pages or on the internet or on individual computers will meet the Client's requirements at all times or that the operation of the web pages will be uninterrupted or error-free.
IX. In no event will Exceptional National Marketing be liable to the Client or any third party for any damages, including but not limited to any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate the web pages or web site. Pay Pal Clients are fully responsible for their web site transactions and their Pay Pal account(s).
X. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.
XI. The Client represents to Exceptional National Marketing and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, logos or other artwork furnished to Exceptional National Marketing for inclusion in Client's web pages are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect and defend Exceptional National Marketing and its subcontractors from any claim or suit arising from the use of such elements furnished by the Client.
XII. From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. The Client agrees that the Client is solely responsible for complying with such laws, taxes and tariffs and will hold Exceptional National Marketing and its subcontractors from any claim, suit, penalty, tax or tariff arising from the Client's exercise of Internet electronic commerce.
XIII. All design work and elements are owned by Exceptional National Marketing remain with Exceptional National Marketing and Exceptional National Marketing retains the rights to display graphics and other web design elements as examples of their work in their respective portfolios and web sites.
XIV. Client understands that a new or transferred domain name and or newly published web pages may not be visible on the internet instantly. This process is called propagation and can take up to 72 hours. Until your domain and/or page has propagated, your web site and email will not function. A temporary URL is usually provided by your hosting provider which you may use to view your web site until your web site is fully propagated.

Exceptional National Marketing
Domain Name
One free domain name or domain transfer is included with hosting package offered by Exceptional National Marketing. Client understands that any charges incurred for new domain or transfer of domain to outside hosting is Client's responsibility. Set up of transfer is Client's responsibility.
Hosting
The Client understands that any web hosting services requires a separate contract with a web hosting provider. The Client agrees to select and purchase a web hosting service which allows Exceptional National Marketing full access to web building capabilities through the hosting site's builder or FTP - file transfer of ENM's software. Client understands that some features may or may not be available depending upon the hosting provider they have chosen. All costs for hosting are separate from web design and publishing and are the Client's responsibility. When choosing an outside hosting company, Client may incur additional costs.
The Client further understands that all hosting sites are different and it is impossible for Exceptional National Marketing services to know the ends and outs of each individual company. It is the Client's full responsibility to learn what is included with their hosting purchase. Exceptional National Marketing may make recommendations and/or suggestions but most inclusions/exclusions and sometimes full inclusions/exclusions are not known until the Client has signed up for said hosting.
Maintenance
A separate contract will be provided for maintenance of web site if desired by Client. If Client wishes to maintain their own site then Client is responsible for any and all software that is necessary for this maintenance. Instruction and consultation for Client's own maintenance can be provided at an hourly charge.
Text
Basic page includes up to 200 words of text supplied by Client. Premier page up to 500 words. PROOF READING is entirely up to the Client. Exceptional National Marketing proofs all pages but will not be held responsible for errors in Client's text. Exceptional National Marketing strives for accuracy, however, Client understands that proofing each page is their responsibility. Additional text and/or supplying text will be charged at an hourly rate.
Photos - Clip Art - Graphics
Photos and other graphic items such as logos to be supplied by Client. Exceptional National Marketing can provide photos that are purchased by Client and/or are copyright free. Exceptional National Marketing can also supply photos at an agreed upon amount between ENM and Client. Basic page includes up to 4 photos. Premier page up to 20 photos. Galleries and slideshows up to 20 photos. Researching, obtaining, resizing, formatting and manipulating photos and graphics is charged at an hourly rate.
Links
Internal page links are included. Basic page includes up to 5 internal photo/graphic/flash/text links. Premier page includes up to 25 photo/graphic/flash/text links. Additional internal and all external links are charged at an hourly rate.
